We have advised and represented Industrias AlEn in defending novel trademark rights such as Cloralex against competitors seeking to take advantage of its distinctive color. We have also advised them on creating aggressive litigation strategies to highlight the distinctive elements of some of their trademarks that were exploited in bad faith by their competitors.
We advised and defended a technology company that owns a famous trademark in the transportation and mobility sector against an aeronautical company that obtained a trademark that incorporated an identical phonetic and conceptual element, generating an unjustified association in the consumer’s mind and unduly taking advantage of the reputation of our client’s trademark. After arguing the similarity and unfair competition that existed, our counterpart’s registration was canceled
